1. About these Terms

These Terms of Service (the "Terms") govern your access to and use of Mochareel(the "Service"), available at https://mochareel.com. Mochareel is operated by an individual based in India ("Mochareel", "we", "us", or "our"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

2. What Mochareel is

Mochareel is a creative tool that turns short text prompts and images into animated videos. It is built for family-friendly storytelling — for educators, parents, storytellers, and creators who want to make short animated content that is suitable for general audiences, including children.

Generation is metered in credits, which you buy in packs. The Service is currently in early access and may be invite-only, feature-limited, or unavailable at times. Features may change or be removed.

3. Who can use Mochareel

You may use the Service if you can form a legally binding contract with us under the laws applicable to you. If you are under the age of majority where you live (for example, under 18 in India and in many other countries), a parent or legal guardian must read these Terms with you, accept them on your behalf, and take responsibility for your account, any payments made through it, and your activity on the Service. Where local law requires verifiable parental consent or sets a specific minimum age for online services, those local rules apply.

The Service is currently available only to accounts that have been granted access. Access can be limited or revoked by us at any time.

4. Accounts

You sign in with Google. You are responsible for the security of the Google account you use, and for everything that happens under your Mochareel account. Do not share your account, do not create more than one account for yourself, and do not use another person's account without their permission. Keep the information associated with your account accurate and up to date.

We may suspend or terminate accounts that we reasonably believe violate these Terms or that pose a risk to the Service or other users.

5. Credits and payments

You purchase credits in packs at the prices shown on the pricing page. Payments are processed by Polar, which acts as the Merchant of Record for your purchase. Mochareel does not receive or store your full card details. Applicable sales taxes and VAT are calculated and collected by Polar at checkout.

Credits are a virtual currency for use only within the Service. They have no cash value, are non-transferable, and cannot be redeemed for cash. Purchased credits do not expire while your account is active. Pricing, pack contents, and the credit cost of generations may change with reasonable notice.

Refunds are governed by our Refund Policy.

6. Your content

"Your Content" means the prompts, narration scripts, images, and any other material you submit to the Service. You keep ownership of Your Content. You promise that you own it or have all the rights, licenses, consents, and permissions needed to submit it and to allow us to process it as described in these Terms and our Privacy Policy. You are solely responsible for Your Content.

You acknowledge that Your Content is transmitted to third-party artificial-intelligence providers so that we can produce the output you request, and that those providers may store or process Your Content in jurisdictions outside India and the European Economic Area. By submitting content, you authorize this transmission and processing. See our Privacy Policy for details about which providers we use and how your data is handled.

7. Generated content and licenses

"Generated Content" is the videos, images, audio, and other output the Service produces from Your Content. As between you and us, you own the Generated Content you create and may use it for personal or commercial purposes, subject to these Terms and applicable law.

You grant Mochareel a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and create derivative works of Your Content and the Generated Content so that we can (a) operate, provide, and improve the Service, and (b) promote and market the Service — for example, by showcasing example outputs and prompts on our website, in our app, and on our social channels. You can opt out of marketing use at any time by emailing support@mochareel.com; opt-out applies on a going-forward basis.

AI-generated output may not always be original or unique. Similar prompts may produce similar results for other users. You should not assume that any specific element of Generated Content is exclusive to you.

8. Community standards and acceptable use

Because Mochareel is built for family-friendly storytelling, the content created on the Service must be suitable for general audiences, including children. You agree not to use the Service to create, upload, share, or otherwise produce:

  • sexual or sexually suggestive content, nudity, or other adult material of any kind;
  • child sexual abuse material (CSAM), or any content that sexualizes, endangers, or exploits minors. We have zero tolerance for this and will report it to the relevant authorities;
  • non-consensual intimate imagery, sexual deepfakes, or other content that falsely depicts a real person in a sexual or intimate situation;
  • graphic violence, gore, torture, or content that glorifies or instructs self-harm or suicide;
  • content designed to disturb or traumatize children, including extreme horror imagery or themes inappropriate for general audiences;
  • hate speech, harassment, or content that incites violence or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics;
  • content that promotes dangerous, illegal, or age-restricted activities to children (including alcohol, tobacco, drugs, gambling, or weapons);
  • content that impersonates a real person or organization in a misleading way, or that is intended to defraud, deceive, or spread misinformation;
  • content that infringes any patent, trademark, copyright, trade secret, right of publicity, or other intellectual property or proprietary right of any third party;
  • malware, phishing material, or content intended to disrupt or compromise any system or network;
  • attempts to reverse engineer, scrape, overload, probe, or interfere with the Service, or to bypass rate limits, allowlists, or other protective measures.

We may remove content, restrict features, suspend, or terminate accounts that we reasonably believe violate this section, with or without notice.

9. AI output disclaimer

Generated Content is produced by machine-learning models and may contain inaccuracies, biases, or unexpected material. We do not guarantee that Generated Content will be accurate, suitable for any particular purpose, free of third-party rights, or aligned with your expectations. Always review Generated Content before sharing it, especially before showing it to children.

10. Intellectual property complaints

If you believe that content on the Service infringes your intellectual property rights, email support@mochareel.com with: (a) a description of the work you claim has been infringed, (b) the URL or other location of the allegedly infringing material, (c) your contact details, and (d) a statement that the information you provide is accurate and that you are authorized to act on behalf of the rights holder. We will investigate and act in good faith, including by removing material where appropriate.

11. Service availability

The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, secure, or that defects will be corrected. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service and all Generated Content are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

13. Limitation of liability

To the maximum extent permitted by applicable law, Mochareel and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses arising out of or in connection with your use of, or inability to use, the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you have paid to Mochareel in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies even if a remedy fails of its essential purpose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mochareel and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

15. Termination

You may stop using the Service at any time. You can request deletion of your account by emailing support@mochareel.com. We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including sections on Generated Content licenses, disclaimers, limitations of liability, indemnification, and governing law) will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting an updated version on this page with a new "Last updated" date or by emailing you. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable consumer-protection rights, you and Mochareel agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in India.

18. Communications and marketing emails

We send two kinds of email. Service emails — such as account, security, and purchase-related messages, and replies to your enquiries — are necessary to operate the Service and are sent regardless of your marketing choices.

Marketing emails — product news, new features, tips, and promotions — are turned on by default when you create an account. You can turn them off at any time using the unsubscribe link in any marketing email or from your email preferences page, and you can turn them back on the same way. Opting out applies to marketing emails only and does not affect service emails. You can also email support@mochareel.com for help with your preferences.
